There is Almost No Recourse For Being Laid Off in India

Oracle is reportedly set to announce layoffs – 30,000 worldwide and God knows how many in India.

Amazon is definitely laying off 16,000 people globally – that includes 500 – 700 (unofficially more) in India. The company announced it publicly in a blog post. In Amazon US, the company promises transition benefits including severance pay and others.

In India, those who are laid off legally get nothing.

Legally, what can an employee do if laid off? What are the rights in India that an employee can avail in the event of severance?

Sadly, very little.

You have to read your employee contract and see if there’s any CIS (Company Initiated Separation) benefit or reimbursement.

You may probably be “paid” your notice period.

Your final settlement is a right, whether you resign or it’s a CIS.

Check if the company has a layoff policy, maybe it’s buried deep in one of the obscure HR policies.

But don’t ask HR hoping for an answer other than “we’ll get back to you”.
